A Tale of Unjust Termination

Emma, a member of the Queensland Branch of the Nurses Professional Association of Australia (NPAA), devoted over five years of service to her employer. However, her workplace underwent a distressing transformation, becoming increasingly toxic over the past year. Emma diligently documented numerous instances of unacceptable workplace events and bullying behaviour, which took a toll on her mental well-being, resulting in severe anxiety

The breaking point came when Emma was notified of an out-of-hours compulsory meeting with less than 48 hours notice. Despite having prior engagements, Emma's employer insisted on her attendance. When she expressed her inability to attend due to her other commitments, her employment was abruptly terminated.

Emma turned to the NPAA for support. Recognizing the gravity of Emma's situation, we assigned a dedicated case manager to her case. Together, they strategized the best course of action, opting to pursue an Unfair Dismissal claim.

Emma and her case manager meticulously prepared the necessary paperwork and filed for an Unfair Dismissal claim. Subsequently, they attended conciliation sessions in hopes of reaching an amicable resolution. Despite their efforts, a settlement remained elusive, and the matter proceeded to trial.

Before the trial could commence, private sessions following conciliation led to a breakthrough. Emma's perseverance and the support of NPAA culminated in a settlement where Emma received $45,000 in compensation and a resignation instead of termination. This outcome not only provided Emma with the financial means to move forward but also ensured that justice was served.
